TERMS & CONDITIONS
1. Introduction
1.1. This Promotional Competition is conducted by Truman and Orange (Pty) Ltd, a company incorporated in the Republic of South Africa and having its registered address at Hudson Building, 30 Hudson Road, De Waterkant, Western Cape (The Promoter).
1.2. Any person who enters the Promotional Competition (“the Participant”) acknowledges that the terms and conditions set out herein shall be binding on them, and further, that the Promotional Competition shall be subject to the provisions of the Consumer Protection Act No. 68 of 2008 (“the Act”).
1.3. Any person who is a director, member, partner, employee or agent of, or a consultant to the Promotor, or any person who directly or indirectly controls or is controlled by the Promotor, is permitted to participate in this Promotional Competition as it’s a game of chance and the winner cannot be chosen by any member of the promoter.
1.4. It is specifically recorded that this Promotional Competition is not dependent on the purchase of Don Papa Rum.
2. RULES OF PROMOTIONAL COMPETITION
2.1. The Promotional Competition shall commence on the 22nd of November 2021 and end on the 5th of January 2021, with only 4 dates incorporated into competition for a Poker evening (8th December 2021, 15th December 2021, 29th December 2021, 5th January 2021).
2.2. Participants must be a citizen or a permanent resident of South Africa, be in possession of a valid South African Identity Document, a Passport, and must be 18 years or older as at the date on which the Participant enters the Promotional Competition.
2.3. To enter the Promotional Competition, proposed Participants must purchase a ‘Sugarlandia is Calling’ ticket via Quicket, using the link https://www.quicket.co.za/events/158176-don-papa-sugarlandia-is-calling-poker-cigar-evening/#/
2.4. By entering the Promotional Competition, Participants stand a chance to win the choice of a golf experience or a spa voucher to the value of R5000, on any of the above dates stipulated in clause 2.1. above. There are 8 prizes in total available to win for the total Promotional Competition period, with 2 prizes only available per Poker night.
2.5. Participants may enter the Promotional Competition as many times as they wish, provided that they have bought the R300 ticket from Quicket for any of the dates referred to in clause 2.1 above.
2.6. The game of Poker for each date stipulated in clause 2.1 shall be governed by the general Poker tournament rules as stipulated in Annexure A.
2.7. Prizes are not transferrable, and may not be deferred, changed or exchanged for any other item or cash.
3. SELECTION OF WINNER/S AND CLAIMING OF PRIZES
3.1. Participants to whom prizes will be awarded will be those 2 players at each poker table on the night with the most value in chips.
3.2. Winners will be announced on the night of the poker evening booked and played.
3.3. Should a Participant win a prize, the Participant undertakes to expeditiously do all things necessary to enable the Promoter to comply with all of its obligations in terms of the Act, including but not limited to, providing such personal information as may be required in order to facilitate the handing over of the prize (including providing proof of address and identity number, and signing receipt of the prize upon it being necessary).
3.4. The Promoter will require the winner/s to complete and submit an Information Disclosure Agreement and an Indemnification, to enable the Promoters to ensure full compliance with the terms and conditions of the Promotional Competition, and the Act. Should the winner/s refuse or be unable to comply with this rule or any other rule contained herein, such winner/s will be automatically disqualified.
4. IMPORTANT NOTICES
4.1. The Promoter does not make any representation or give any warranties, whether expressly or implicitly as to a prize, and in particular, without limitation, makes no representations and gives no warranty that a prize, or any aspect thereof, will –
4.1.1. meet the Participant’s requirements, preferences, standards or expectations; or
4.1.2. be satisfactory and punctual.
4.2. The Participant acknowledges that he/she shall not be entitled to claim a prize, should it be unlawful for the Promotor to supply such a prize to the Participant. Should the Participant not qualify to receive such a prize, the Participant acknowledges that he/she shall be required to forfeit it.
4.3. The Promoter reserves the right to vary, postpone, suspend, or cancel the Promotional Competition and any prizes, or any aspect thereof, without notice, for any reason whatsoever. In the event of such variation, postponement, suspension or cancellation, the Participant agrees to waive any right, interest and expectations that he/she may have in terms of the Promotional Competition, and acknowledges that he/she will have no recourse against the Promoter.
4.4. The Participant agrees that by participating in the Promotional Competition, and his/her acceptance and/or use of a prize, or any aspect thereof, is at his/her own risk.
4.5. The Participant undertakes to sign a waiver of liability and indemnity indemnifies The Promoter against any claims whatsoever, before claiming any prize. The Promoter cannot be held responsible for any accident, injury or loss of property, consequential loss, as a result of winning, accepting and/or utilising the prize/s won.
4.6. Notwithstanding the above, all Participants and the winner/s, as the case may be, indemnify the Promoter, its advertising agencies, advisors, nominated agents, suppliers and its affiliates and/or associated companies, against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this Promotional Competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promotor and/or use of the Prize).
5. GENERAL
5.1. Notwithstanding clause 2.1, as read with Items 2 and 3 of the Schedule, the duration of the Promotional Competition may be altered at the sole discretion of the Promoter. The Promoter shall have the right to terminate the Promotional Competition immediately, and without notice, for any reason beyond its control.
5.3. The Promoter may require the winner/s to be identified and photographed, and that the photographs be published in printed media, or to appear on radio and television, or in accepting their prizes, and/or after having received prizes. The winner/s will be given the opportunity to decline to the publication of their images and to participate in the Promoter’s marketing material insofar as it relates to the Promotional Competition.
5.4. Should any dispute arise in relation to the interpretation of the Promotional Competition and/or its terms and conditions, the Promoter’s decision shall be final and binding, and no correspondence shall be entered into.
5.5. These terms and conditions will be construed, interpreted and enforced in accordance with the applicable laws of the Republic of South Africa.
5.6. In the event that any of the terms and conditions contained herein are found to be invalid, unlawful or unenforceable, such terms will be severable from the remaining terms of these terms and conditions, which will continue to be valid and enforceable.
ANNEXURE A
General Poker Terms & Conditions:
1. CONDITIONS OF ENTRY
1.1 All applications for entry must be made and purchased on the official Quicket Sugarlandia Is Calling website.
1.2 Entries for a particular tournament may be transferred to another player provided that player has not already entered that tournament.
1.3 All entrants must abide by the tournament rules. Failure to do so may result in disqualification from the tournament.
1.4 Entrants disqualified from the tournament are not entitled to a refund of the Entry Fee and Administration fee and that entrant’s tournament chips will be taken out of play.
1.5 All entrants shall agree to such playing times as designated by the Quicket booking platform (6pm for each evening stipulated upon booking).
1.6 Truman & Orange, in collaboration with Don Papa SA reserves the right to use selected entrant’s names, suburbs, photographs, images and likeness for the purpose of promoting and advertising the casinos.
1.7 The evening will be hosted by Gaming Events South Africa, using artificial money and chips.
1.8 All players will be allocated a table stake of non-value Tournament Chips at the commencement of play.
1.9 Chips may not be redeemable or transferred for South African Rands.
2. GAME DETAILS
2.1 There will be 4 hours of Poker for each evening starting at 6pm and end by 10.30pm. Should there not be a clear winner at the end of the evening, the person with the most value in number of chips will win the evening.
2.2 At the conclusion of the tournament heat or final, the players shall return all tournament chips which shall be counted by the staff to determine that their number and value is equal to the number and value of tournament chips issued to be used for that tournament heat or final.
2.3 If a player is not present at the table at the start of the tournament, then that player shall forfeit his or her position for the evening, and forego their R300 booking fee, Don Papa cocktail and Cuban Cigar.
2.4 A player shall not lend or borrow Tournament Chips at any time.
2.5 Where two or more all-in players who would have been eligible for place in the tournament, are eliminated in the same round of play, the winner/place getter shall be the player who had the higher table stake before the round of play in which they were eliminated commenced. If players had the same value table stake at the commencement of the round of play, then a draw of cards shall determine the winner or place getter. Commencing with the player on the immediate left of the designated player and in a clockwise direction, the dealer shall deal one card face down to each player. Players shall turn their cards face up and the player holding the highest card shall be declared the winner. Should two or more players hold an equal value card, further card(s) shall be dealt to those players until a winner is decided. Ace shall be counted as high.
